Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Calibrated Music Library, including any content, features, tools, and services offered through the platform. These Terms constitute a legally binding agreement between you and Calibrated Resilience® Holdings (“the Company,” “we,” “our,” or “us”).

By accessing the platform, completing the emotional state check-in, or submitting your email address through the Calibrated Music Library, you represent that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them in full.

The Calibrated Music Library is a music prescription platform that maps users to curated music content based on emotional state intake data. The platform provides access to original music catalogs published under StormForged Music Publishing. The platform may include features such as emotional state assessments, curated playlists, guided listening tracks, institutional licensing portals, and integration with third-party streaming services.

The platform is a wellness and resilience support tool. It is not a licensed clinical service, mental health treatment program, or medical intervention. Access to the platform does not create a therapeutic, clinical, or fiduciary relationship between the user and the Company or any of its representatives.

The Calibrated Music Library does not require account creation. The platform collects limited information through the emotional state check-in process, including your email address, emotional state assessment responses, mood result category, persona selection, and whether you are taking the check-in for yourself or someone in your life. By submitting your email address, you agree to:

• Provide an accurate and current email address
• Accept responsibility for any information you submit through the platform

You may not use the platform for any unlawful purpose, to harass or harm others, to impersonate any person or entity, or to circumvent any access restrictions implemented by the Company.

Organizations, agencies, schools, recovery programs, and other institutional partners that access the platform under a licensing or partnership agreement are subject to the specific terms of their executed agreement with Calibrated Resilience® Holdings. In the event of a conflict between these Terms and an executed institutional agreement, the institutional agreement controls with respect to the licensed use.

All content available through the Calibrated Music Library — including but not limited to music recordings, lyrics, artwork, frameworks, assessment tools, branding, and written materials — is the proprietary property of Calibrated Resilience® Holdings or is licensed for use by the Company from authorized rights holders. All content is protected under applicable United States and international intellectual property laws.

You may not reproduce, distribute, publicly perform, publicly display, modify, create derivative works from, or otherwise exploit any content available through the platform without prior written authorization from the Company. Calibrated Resilience® is a federally registered trademark. All other marks, including Aurora Stronghold, Elias Ironside, StormForged Music Publishing, Engineer Your Unbreakable, and all associated framework and program names, are proprietary marks of the Company.

You agree not to:

• Record, copy, download, or redistribute any audio content from the platform without written authorization
• Use automated tools, scrapers, or bots to access platform content
• Reverse engineer, decompile, or attempt to extract source code from any platform application or algorithm
• Use platform content in any commercial context without an executed licensing agreement
• Misrepresent your identity, credentials, or affiliation with any organization when accessing the platform
• Use the platform in any manner that could damage, disable, overburden, or impair its functionality

The Calibrated Music Library is provided on an “as-is” and “as-available” basis. The Company makes no warranties, express or implied, regarding the platform's availability, accuracy, fitness for a particular purpose, or freedom from error. The Company does not warrant that the platform will be uninterrupted, secure, or free of viruses or other harmful components.

The Company makes no representation that the platform constitutes or replaces professional mental health treatment, clinical therapy, crisis intervention, or medical care of any kind. If you are experiencing a mental health emergency, please contact emergency services or a crisis hotline immediately.

To the maximum extent permitted by applicable law, Calibrated Resilience® Holdings, its founders, officers, employees, contractors, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of or inability to use the platform, including but not limited to damages for emotional distress, loss of data, loss of profits, or any other intangible loss.

The Company reserves the right to update or modify these Terms at any time. Updated Terms will be posted on the platform with a revised effective date. Continued use of the platform following the posting of updated Terms constitutes your acceptance of those changes. It is your responsibility to review these Terms periodically.

These Terms are governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Baltimore, Maryland.
